RULES OF ACCESS AND USE OF THE LENTISCO ALENTTO WEBSITE
- Owner of the web page and provision.
The professional office Lentisco Alentto S.L.P., is the owner of this website, hereinafter the Page, as well as of all its contents and of the trademarks and distinctive signs that appear in it. The professional firm Lentisco Alentto S.L.P., hereinafter referred to as the Firm, is domiciled at Calle Alcalá 67, 2nd floor, 28014 Madrid, CIF: B87271110, registered in the Mercantile Registry of Madrid, volume 33.370, folio 180, first inscription, with telephone number 918 216 283, and e-mail info@lentisco.es. Lentisco makes available to Internet users the Site, whose use is governed by these conditions and rules of access and use, and in all matters not covered by them, by the law applicable in each case.
Access to and use of the Site shall be free of charge in general, with the exception of the costs of connection to the Network supplied by the Internet access provider with whom the user has contracted such connection, and of those special services or services under tariffs that the Firm may offer at any given time, in accordance with the specific regulations or conditions that may have been made available to users, as the case may be.
- Acceptance.
The access and use of the Site by the Internet user, hereinafter the User, implies acceptance of these rules and conditions. The Firm may, at any time, change the rules of access and use, so that this Legal Notice may undergo changes that should be consulted by the User each time you are about to make use of the services and information provided through the website of Lentisco.
3.Conditions of use of the Site and its contents.
The User must use the Lentisco Site in accordance with the requirements of good faith, the provisions of this Legal Notice, as well as the laws in force. Any use contrary to the terms of this Legal Notice, or to applicable law, will give rise to the birth and the demand to the User of the responsibilities that may arise, either against the Office, or against third parties who may have been injured their rights because of misuse.
To this end, Lentisco strictly prohibits the use of its Page for any use that may cause damage, even in an unlikely manner, to the rights and interests of both the Firm itself and all kinds of third parties, including Internet service providers and owners of data storage services, or products, applications or computer terminals.
- Contents of the Site and intellectual and industrial property.
The contents of the Lentisco Site must be used by the User in accordance with the provisions of this Legal Notice and current legislation on the protection of intellectual and industrial property, in accordance with which the User is prohibited:
- Distribute, reproduce, alter, modify, copy, transmit or make available to third parties, whether publicly or privately, and for any purpose, the content of the Site, unless expressly authorized by the Firm or by the owners of the rights that do not belong to it, and in respect of which the Firm has a right of exploitation or use.
- Use, reuse, transfer, transmit, copy or reproduce those parts or contents of the Site that may be considered, for the purposes of intellectual property legislation, as Software or Database.
Likewise, the entire content of the Site, whether graphic, visual, audiovisual, web design, software, links and source codes are the exclusive intellectual property of Lentisco, limiting the possible uses by the User to the access and use of the Site. Regarding the logo, design, trademarks, trade names or any distinctive signs that appear on the Page are owned by Lentisco, without the use of the Page constitutes any concession or transfer of rights in intellectual property and trademark protection.
- Data entered by the User through the Site.
When the provision of a service offered by the Firm requires the communication of data by the User, it will be used for this purpose models or forms that are provided for this purpose by the Page. The User shall be solely responsible for the accuracy of the data provided through such systems, without the Firm having any responsibility for its inaccuracy or falsity.
The Firm will observe in all data collection through the Site the provisions of the current regulations on the Protection of Personal Data.
- Use or forwarding of Lentisco’s website through links.
The use of links to other web pages is prohibited, except in the case of the home page, which may be forwarded by means of links, provided that the forwarding does not contain “frames” that reproduce the entire content of the Page or allow its visualization from Internet addresses other than that of the Page itself, in which case the link or forwarding is strictly prohibited.
Likewise, the Firm does not authorize the use of its Internet portal in such a way that it can be reproduced or visualized together with other contents of other web pages, or in any other way that may lead to error or confusion about the true content of the Site, its owner and the services and information it contains, as well as to carry out comparisons or samplings that have not been previously authorized by the Firm.
The use of links in no case authorizes the user to incorporate his own opinions about the Firm, as well as to make evaluations of its services or contents, which if produced must be published by his own means, and omitting the use of the Page’s own elements, including the link to any of its pages.
The possibility of making a link does not imply any transfer, permission or authorization by the Firm for the use or utilization of its name, logo, trademark, graphic and web design, contents, opinions and information, being responsible whoever makes any non-consensual use of such elements in accordance with current legislation.
It is forbidden the introduction of the link to the home page of the Lentisco website, or any of its pages, in all those pages whose content is contrary to the law, morality and good customs, such as pages with racist, xenophobic, pornographic, etc. content. The use of links to pages of political organizations or political opinion is not authorized, unless expressly authorized by the Firm.
- Limitations on the Firm’s liability.
A) Regarding the service, and the quality thereof.
The service offered by the Site is limited to the possibility of accessing it to learn about the services and products provided by the Firm, as well as, where appropriate, the professional opinions that may be made public. The service is provided in accordance with the legislation in force, and the Firm assures that its content is free of viruses and other harmful computer elements. However, it is the User’s responsibility to have the necessary anti-virus, anti-malware or firewall tools for safe Internet browsing.
To this effect, the Firm assumes no liability in the event of any damage to the User’s computer equipment while browsing or viewing the Site.
The availability of access to the Site does not depend directly on the Firm, so it will be the connection service provider who must ensure the possibility of access at all times, being responsible for any interruption or suspension of the connection that could cause any kind of damage, inconvenience or loss of information to the User. In the event that the service is not available for any reason, the Firm will duly announce it by means of an informative page of the interruption of the service and the reasons for it.
B) Regarding the contents and services offered by the Site.
The Firm is not responsible for the opinions or information of third parties that incorporates to its Page, being such third parties responsible for such opinions or contents. However, if the Firm becomes aware, or is informed by users of the inaccuracy, illegality or falsity of any information or content published on the Site, it will immediately proceed to remove it.
The content of the Page does not constitute a binding offer in any case, nor does it have any direct effect on the relationship with the User or the Client, to the extent that it is merely general information lacking specific legal value. If the User is interested in any of the services or products that the Firm makes available to him/her, he/she must initiate the normal procedure for contracting such services or products in person, or through the mechanisms that the Firm expressly makes available for this purpose.
In accordance with the foregoing, the Firm is not responsible for any decisions that, at a particular level, may have been made by the User, due to the reading of the contents and opinions expressed on the Site, and for any possible damages that such decisions may have caused to the User.
C) Of the contents of third parties accessible from the Site.
When, from the Page, it is possible to access other Internet portals, or services such as search engines or directories, the Firm will act as a provider of intermediation services, in application of the provisions of article 17 of Law 34/2002, of July 12. To such effect, its responsibility is limited to the assumptions in which, knowing that the contents or services to which it has access through its Page have illicit character, it has not proceeded to its immediate elimination.
To this effect, if the User has knowledge that the linked pages or services are of an illicit nature, or against morality and good order, he/she may communicate it through the e-mail info@lentisco.es, indicating his/her identity and the reasons for which he/she considers that the aforementioned circumstances exist, providing, if available, the evidence that proves such extremes.
However, such communication will not determine the obligation of the Firm to remove the links or services, insofar as it is up to the Firm to assess whether the necessary conditions for this are met, nor will it entail knowledge of the unlawfulness or illegality of the contents or services indicated by the communicating party.
- Applicable legislation and jurisdiction.
For all matters relating to the interpretation and application of these rules of access and use of the Lentisco website, Spanish law shall govern, under the jurisdiction of the Courts and Tribunals of the Kingdom of Spain.
